Participation Requirements:  All bidders must be at least 18 years of age.  By registering for this auction, the Bidder acknowledges they have read and agree to the terms and conditions of this auction. The winning bidder agrees to sign the contract of sale, pay the down payment the day of the sale and close the transaction within 30 days of the close of the auction.

Hanson Realty and Auction Company, Inc. may require a proof of funds letter to be submitted prior to bidder participation.

This auction is conducted by Hanson Realty and Auction Company, Inc. on behalf of the owners of the property hereinafter referred to as the (Seller). Submitting a bid constitutes the Bidder’s acceptance of these terms and shall form a binding contract of intent to purchase between the Bidder and the Hanson Realty and Auction Company, Inc.

AUCTIONEER’S AUTHORITY: Hanson Realty and Auction Company, Inc. reserves the right to deny or restrict any bidder’s registration with or without cause.

Under no circumstances shall Bidder have any type of claim against Hanson Realty & Auction Company, Inc. Hanson Realty & Auction Company, Inc. will not be responsible for missed bids from any source.

Terms:  Property is selling “as-is, where is” with all faults and is selling subject to easements, leases, restrictions, zoning, covenants, conditions and all other matters revealed by a survey or by inspection of the property or contained in public records.

 ALL SALES ARE FINAL and are not subject to any financing, appraisal, or inspections.  It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factors. Hanson Realty & Auction Company, Inc. may attempt to describe the property but makes no representations. In no event shall Hanson Realty & Auction Company, Inc. be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. All sales are final. 

Bidders who bid from off-site acknowledge that they may not be able to inspect the property as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Bidders must rely on their own judgment, knowledge and inspections.

Hanson Realty & Auction Company, Inc. will not be responsible for any errors or omissions in the description of the property unless it is a material and intentional misrepresentation of the property itself. The Bidder agrees that the property is sold AS-IS.

All persons inspecting the property assume all risks of damage or loss to person and property and specifically release Hanson Realty and Auction Company, Inc. and Seller from all liability.

Hanson Realty and Auction Company, Inc. as Agents of the Seller only are not responsible for Warranty of Title or Guarantee of Acreage.

The risk of loss or damage to said property by fire or other casualty is assumed by Seller until Deed is delivered.

PAYMENT TERMS: A $10,000 down-payment is due within 24hrs of the close of auction and balance due at closing within 30 days. Down-payment as used in the contract shall mean “A portion of the purchase price paid in advance to guarantee payment of the whole when Deed is presented.” Down-payment must be made by cash, a verified cashier’s check from a U.S. bank or wire transfer. Please note that this is a non-contingent transaction and is not contingent upon inspections, financing, or appraisal.

Sale is subject to Seller’s approval. 

Buyer’s Premium:  There is no Buyer’s premium for this auction.

Broker Participation:  Hanson Realty and Auction Company, Inc. will pay a 1% commission to a properly licensed Brokerage whose client purchases and closes on the real estate. To qualify, the Brokerage must register by completing the Hanson Realty and Auction Company, Inc., Auction Buyer – Brokerage Agreement. Please contact our office at staff@hansonrealtyandauction.com for a copy of the agreement. Agreement must be received and approved by 1:00 pm (CST) Thursday December 19, 2024.
